Failior Terms and Conditions

These Terms and Conditions set the rules for using Failior, including our monitoring platform, dashboards, APIs, SDKs, notifications, and related public website features.

Acceptance of Terms

These Terms and Conditions govern your use of the Failior website, dashboard, APIs, SDKs, monitoring services, browser RUM tools, notifications, and related offerings. By accessing or using Failior, you agree to these terms on behalf of yourself or the organization you represent.

If you do not agree to these terms, do not use Failior. If you are using the service for an organization, you represent that you have authority to bind that organization to these terms.

Accounts and Eligibility

You must provide accurate information when creating an account, keep your credentials secure, and promptly notify us of any unauthorized use or suspected security incident. You are responsible for activity that occurs under your account unless caused by our breach of these terms or applicable law.

We may suspend or restrict access if we believe an account has been compromised, is being used unlawfully, or presents risk to the service or other users.

Use of the Service

Failior is intended for operational monitoring, reliability analysis, performance tracking, incident response, and related internal business use cases. You may use the service only in compliance with applicable law and these terms.

You remain responsible for the systems you monitor, the destinations you test, the telemetry you send, and the notification endpoints or recipients you configure.

  • You may not use Failior to break the law, interfere with networks you do not control, or run abusive monitoring, scraping, or traffic generation.
  • You may not attempt to reverse engineer, disrupt, overload, or bypass Failior security controls except where such restriction is prohibited by applicable law.
  • You may not upload or transmit malicious code, unlawful content, or data you do not have the right to process through the platform.
  • You may not use Failior to send spam, unsolicited bulk messages, or unlawful SMS, email, or webhook traffic.

Customer Data, Monitoring Data, and RUM Telemetry

You retain ownership of the data, configurations, and telemetry you submit to Failior, subject to the rights you grant us to host, process, transmit, analyze, and display that data as necessary to provide the service. That includes monitoring targets, dependency graphs, notifications, RUM telemetry, incident logs, and related operational information.

You represent that you have all rights and permissions necessary to provide that data and to instruct us to process it. You are responsible for ensuring that your use of RUM, alerting, and diagnostic features is lawful and appropriate for your users, systems, and jurisdictions.

SMS, Email, and Notification Terms

If you configure Failior to send phone, email, webhook, or similar notifications, you are responsible for ensuring that the configured recipients have consented where required and that your use of those channels complies with applicable communications laws, carrier rules, and provider policies.

By enabling SMS notifications, you authorize Failior to send operational or account-related text messages to the phone numbers you configure. Message frequency varies by incident volume and account activity. Message and data rates may apply. Carrier delivery is not guaranteed, and downstream providers may filter, block, or delay messages.

  • Reply-based carrier commands such as STOP or HELP may affect message delivery according to provider and carrier rules.
  • You must not use Failior notifications for unlawful marketing, harassment, or unconsented messaging.
  • We may change, suspend, or restrict notification channels if provider policies, legal requirements, or abuse-prevention controls require it.

Fees, Plans, and Trials

Some Failior features are available only on paid plans or subject to usage limits. You agree to pay applicable fees, taxes, and charges associated with your selected plan. We may change pricing, packaging, or feature entitlements prospectively, subject to applicable law and any commitments we make in an active order or subscription period.

Trials, free plans, credits, and promotional features may be modified, limited, or discontinued at any time.

Third-Party Services

Failior may rely on or integrate with third-party services such as cloud providers, payment processors, messaging vendors, analytics tools, and webhook destinations you configure. We are not responsible for outages, failures, filtering, or policy changes imposed by those third-party services.

Your use of third-party services may also be subject to their separate terms and privacy policies.

Availability, Changes, and Support

We may update, improve, or discontinue features from time to time. We do not guarantee that every feature will remain available in its current form or that the service will be uninterrupted or error-free at all times.

We may perform maintenance, emergency work, security changes, or platform updates that affect access to some or all portions of the service.

Disclaimers

Except as expressly stated by Failior in writing, the service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Failior is an operational tool, not a guarantee against downtime, data loss, security incidents, compliance failures, or other business risks. You are responsible for maintaining your own backups, recovery plans, security program, and incident response procedures.

Limitation of Liability

To the maximum extent permitted by law, Failior and its affiliates, officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities arising out of or related to your use of the service.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the greater of the amounts you paid to Failior for the service during the twelve months preceding the event giving rise to the claim or one hundred U.S. dollars.

Termination

You may stop using Failior at any time. We may suspend or terminate access if you violate these terms, fail to pay fees, create legal or security risk, or misuse the platform. Upon termination, your right to use the service ends immediately, but provisions that by their nature should survive termination will continue to apply.

We may retain limited records as necessary for billing, audit, legal compliance, abuse prevention, or security.

General Terms

These terms, together with any incorporated policies, constitute the entire agreement between you and Failior regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.

We may update these terms from time to time by posting revised terms on the site or otherwise notifying users as appropriate. Your continued use of Failior after updated terms become effective constitutes acceptance of the revised terms.
